The terms that apply when you use the Stratwell Advisory website.

You are welcome to use and share the information on this website, but it is general information, not personal professional advice. A client relationship with us only begins once we have agreed and signed an engagement letter. Please don’t copy our brand or content without permission, and please contact us if anything on the site looks incorrect.

1. About these terms

These terms of use apply to your use of the website stratwell.co.za (the “website”), operated by Stratwell Advisory (“we”, “us” or “our”). By using the website, you agree to these terms. If you do not agree, please do not use the website.

These terms only govern your use of the website. Any professional services we provide to you are governed by a separate written engagement letter.

The articles, guides, FAQs and other content on this website are general information only. They are written with care and reflect the law as we understand it at the date shown, but tax, accounting and company law change often and every situation is different.

Nothing on this website is tax, accounting, legal, financial or investment advice, and you should not act or refrain from acting based on it without first getting advice about your own circumstances. Please contact us if you would like advice.

4. When you become our client

Sending us an enquiry, booking a consultation, emailing us or using this website does not by itself create a client relationship or professional duty of care. We only act for you once we have accepted your instruction, completed our client acceptance and FICA verification procedures, and agreed a written engagement letter setting out the scope of our work and our fees.

Please do not send us confidential documents through the website forms before we have agreed to act for you.

5. Using the website

You may use the website for lawful purposes only. You agree not to:

  • Use the website in any way that breaks the law or infringes anyone’s rights
  • Try to gain unauthorised access to the website, its server or any connected system
  • Introduce viruses, malware or other harmful code
  • Use automated tools to copy or scrape content from the website
  • Submit false, misleading or offensive information through our forms

6. Intellectual property

All content on this website, including text, articles, graphics, the Stratwell Advisory name and logo, our geometric brand patterns and the website design, belongs to Stratwell Advisory or is used with permission, and is protected by copyright and trade mark law.

You are welcome to share links to our pages and articles, and to quote short extracts for non-commercial purposes, as long as you credit Stratwell Advisory and link back to the original page. You may not otherwise copy, reproduce, adapt or distribute our content or branding without our written permission.

7. Accuracy and availability

We take reasonable care to keep the website accurate and up to date, but we cannot guarantee that all information is complete, current or free from errors. Articles show the date at which they reflect the law. We may change, update or remove content at any time without notice.

We aim to keep the website available at all times, but it may occasionally be unavailable because of maintenance, technical problems or factors outside our control.

8. Links to other websites

The website links to other websites, such as SARS, CIPC, professional bodies and our partners, for your convenience. We do not control those websites and are not responsible for their content, availability or privacy practices. A link does not mean we endorse the website or its owner.

To the fullest extent permitted by law, including the Consumer Protection Act, 2008 where it applies:

  • Stratwell Advisory, its directors and employees are not liable for any loss or damage, whether direct, indirect or consequential, arising from your use of the website or reliance on its content
  • We are not liable for any loss caused by viruses or other harmful material that may affect your device as a result of using the website or downloading content from it

Nothing in these terms limits liability that cannot be limited by law, such as liability for gross negligence. Our liability for professional services is governed by the engagement letter for those services.

10. Privacy

We respect your privacy. Our Privacy Policy explains how we collect, use and protect personal information submitted through this website, in line with the Protection of Personal Information Act, 2013.

11. Electronic communications

When you contact us through the website or by email, you agree to receive communications from us electronically. Email is not always secure, so please do not send sensitive information such as banking details or identity documents by email unless we have agreed a secure way of sharing them.

A message sent through our website forms is only considered received once we have confirmed receipt.

12. Governing law

These terms are governed by the laws of the Republic of South Africa. Any dispute arising from them will be subject to the jurisdiction of the South African courts, and you agree to the jurisdiction of the Magistrates’ Court for disputes that fall within its jurisdiction.

We may update these terms from time to time. The latest version will always be published on this page with its effective date, and your continued use of the website means you accept the updated terms.
